For Lack of Subject Matter Jurisdiction… Berg vs. Obama

Judge Surrick rules on October 24, 2008 to dismiss the case filed by Philip J. Berg in Philadelphia District Court concerning Barack Obama’s birth records and his eligibility to serve as President of the United States if elected.

Interesting interpretation of the first conclusion…   ” Berg lacked standing to bring the suit because he did not face direct harm even if the allegations were true”  This is posted on the University of Pennsylvania School of Law website by Devin Montgomery.  He notes that Berg plans to appeal.

I heard about all this when Berg was interviewed on the SavageNation with Michael Savage (Weiner).

So it doesn’t seem as if this got a fair shake and was dumped on a technicality and not on the evidence…

If any lawyer types come across this posting… Please sound off.  If an actual assessment of the evidence was derailed on a technicality… Justice?  Really?
